Annexure 8(53) of the S/T Act provides for a special meeting in 14 days.
What if the Trustees are seriously in the wrong (or wrongdoing) and the owners wants to act immediately against the trustees. Now they must wait 14 days during which period the trustees can cover their tracks.
Shouldn't there be an "Emergency Meeting" clause in the Act or PMR?
Owners must have the means to convene a meeting within a few days to protect their interest. Perhaps the quorum for such a meeting may be more strict than for the other meetings.
What is your view on this matter??? Should this be referred to the Regulation Board????

Q: I am renting a unit in a S/T scheme and I used a room in my unit as my office. I know I have to request from all the owners' permission……………
A: You yourself have no right to make any such request to the B/C, as you are a tenant. Only the owner can do that.
Q: Our house rules state that if the owner has two vehicles, one vehicle needs to be parked in his garage and with permission from the Trustees he may park the other vehicle on the premises. This house rule was established because there has been a shortage of parking in recent months.
A: Firstly your "house rules" have no legal standing. Offenders can refuse to pay any fine you may impose. If you want to be able to impose fines, you will need to incorporate them into your Conduct Rules. This means holding a Special General Meeting, and getting approval for the new rule; then submitting the amendment to the Deeds Office.
Q: My problem is a leaking exit pipe from my shower. I stay in an upstairs unit, and my neighbour downstairs has a leak in her roof, which we suspect is from our shower. The cause of the leak is in the opinion of a plumber, due to the waterproofing not performed correctly during construction. (5 years ago……………..)
A: The B/C insurance policy will not cover the damage as it would if it were the result of a sudden event such as a breakage or bursting.
