TAKE ARREAR LEVY DISPUTES TO ARBITRATION

The following announcement was received from Marina Constas of BBM:

"Our appeal was upheld in the Greenacres case. We heard the good news today.

It is now fully legal to take arrear levy disputes to arbitration.

Wee done to the BBM litigation team on this phenomenal success!!"

CLEARANCE CERTIFICATES //  TRANSFERRING ATTORNEYS

We as Managing agents are all aware of the frustrations that go with the issuing of Clearance Certificates, e.g. costs, staff, updating, follow-up, time etc.

We visited the website: www.managingagents.co.za and met with Sean.  This website may just be the answer to your problems in respect of the issuing of clearance figures and --certificates to transferring attorneys.

In short, it works as follows:-
  1. You create your own website in the managing agent website;
  2. You load all your client information on your website – it is protected by code words and cannot be accessed by anybody but yourself.
  3. When the transferring attorney requests a clearance certificate or statement for payment for the issuing of a clearance certificate, you supply him with a code which puts him in a position to access all information regarding that specific unit;
  4. Once all the requirements in respect of the issuing of a Clearance Certificate have been met, the attorney produces a clearance certificate for the specific unit;
  5. The nice part about this is that you collect your normal fees for issuing the clearance certificate, without lifting a finger!

"NAMA have reviewed a website called www.ManagingAgent.co.za and we have explained below the details and operation of this website from a Managing Agents perspective.

WHY WAS THE WEBSITE DEVELOPED WITH MANAGING AGENTS IN MIND?

Two reasons:
  1. To offer a basic free service to Managing Agents, allowing property conveyancing parties to obtain the essential contact information for the Managing Agent for a specific individual Body Corporate and/or Home Owners Association.
  2. To offer an optional paid service for Managing Agents, to set their own level of automation in requests for the traditional elements of property conveyancing, which if used fully, the value derived exceeds the cost.

HOW WILL THE WEBSITE BENEFIT A MANAGING AGENT?

Owners, Estate Agents, and Transferring Attorneys, are very often not aware of who the Managing Agents are for a complex, let alone how to reach them in order to request information required for the conveyancing of properties. Using this website, the Managing Agents contact details, for a specific individual complex can be determined by a property conveyancing party, so that requests can be made to the Managing Agent, in good time.

The Managing Agent can, to a level of their choice, highly automate the process of receiving and issuing information for property conveyancing, and still recover all their own traditional fees for such requests.

HOW PRIVATE IS THE LIST OF OUR OWN COMPLEXES AS THE MANAGING AGENT?

Very Private. Nobody, other than the Managing Agent for their own complexes, can see what complexes another Managing Agent is involved with. All other website members, including other Managing Agents, need to narrow their search down to one individual complex at a time, in order to obtain the contact details of the Managing Agent for that complex. Other website members need to know exactly what complex they are looking for, before any information is revealed, and even then they need to pay for it.

In theory, another member could systematically work through one complex at a time, and request the contact details of the Managing Agent for one complex at a time. This would be a very long, arduous and costly exercise. It would probably be quicker and cheaper to drive to the complex, and request the details form the security guard.

HOW MUCH INFORMATION MUST A MANAGING AGENT LOAD?

If a Managing Agent for a complex, only wishes to be basically contactable for that complex, then only one page of basic information is needed to be completed per complex.

Should a Managing Agent wish to develop a high level of automation for property conveyancing matters, then the more information that is loaded, the higher the level of automation that is available. The decision as to how much extra information gets loaded for any complex, is entirely left up to the individual Managing Agent.

WHO FROM THE MANAGING AGENT NEEDS TO LOAD THE INFORMATION?

A Principal Member from the Managing Agent is responsible for initiating the loading of a complex, which requires just three (3) lines of data to be entered. If the Principal Member registers other Sub-Members on their portfolio, the Principal can then assign the loading of further information to any individual Sub-Member.

Only one Member at a time will be assigned to an individual complex, and this is under the control of the Principal Managing Agent, who can assign and un-assign individual Sub-Members to individual complexes, at will.

IS IT COMPLICATED FOR A MANAGING AGENT TO LOAD THE INFORMATION?

Not at all. The information required is common day to day detail that a Managing Agent is completely familiar with. In addition there are a number of checks, balances and prompts, which will prevent errors that might otherwise be made.

IS THERE A WAY TO REDUCE THE WORKLOAD ON THE MANAGING AGENT FOR CAPTURING EXTRA INFORMATION?

Yes. If the Insurance Broker, Insurance Underwriter, Auditor, and Owners for a complex are all using the website, then these parties can greatly reduce the workload on the Managing Agent.

CAN A MANAGING AGENT TEST THIS WEBSITE, BEFORE DECIDING:

Absolutely, and Managing Agents can test it for FREE.

There is no cost to register, there is no cost to login, and there is no cost to load a complex on the system.

Managing Agents can load a “test” or “dummy” complex up to the first basic stage, and then delete it, if they wish.

If the Managing Agent wishes to proceed further, then the details for the first basic stage must be for a “real” complex, and not a “test” complex. Proceeding further with details for a real complex, also has no cost implications.

HOW DO WE AS MANAGING AGENTS MARKET THIS TO OUR COMPLEXES

Very easily indeed. The use of this website is completely FREE for all Owners in Body Corporates and in Home Owners Associations, for as long as they remain an Owner. If Owners own property in more than one complex, then they have access to all their own properties in one central Owners portfolio.

Owners can have all their own property conveyancing matters copied to them, so that they can see for themselves at what stage the conveyancing process is, from their complexes point of view. Owners can also confirm the accuracy of details in their conveyancing matters, reducing potential delays in their property transfers.

Nowadays many Body Corporates are formed within Home Owners Associations. In such instance it is commonplace to require the consent of the Home Owners Association for transfer. Very often this link is unknown, and causes delays in the transfer for the Owner. This website will eliminate that problem.

IS THERE ANYTHING ELSE IN IT FOR A NAMA MANAGING AGENT?

There is a limited special offer open to NAMA Members, where members can build a credit balance on their account, to use at any time for the optional paid services, now or in the future. This is described later.

From 01 Dec 2007 all paid up NAMA members will qualify for an extended rewards package.

This is in addition to the referral rewards programme, which is already in place.
