PROMOTION OF ACCESS TO INFORMATION ACT
The Promotion of Access to Information Act, No. 2 of 2000 (“the Act”) in as far as it applies to private bodies, took effect on 15 February 2002. It gives effect to the constitutional right of access to any information held by the State and private bodies and that is required for the exercise or protection of any rights. Where a request for information is received in terms of this Act, the private body is obliged to release the information, except where the Act expressly provides otherwise. The Act sets out the procedures that must be followed for such requests.
The Act prescribes that every private body (including Bodies Corporate), must compile a guide containing information as is set out in the Act. I.e.: ALL BODIES CORPORATE MUST COMPILE SUCH A MANUAL.
The purpose of this manual is to foster a culture of transparency and accountability in public and private bodies.
The extended cut off date for submission of the manual to the South African Human Right Commission is 31 August 2005.
EXCLUSIVE USE AREAS
In the August 2005 issue of "De Rebus", magazine of the Attorneys’ Profession, a very informative article appeared regarding the Exclusive use Areas that is really worthwhile reading.
Due to the length of the article it cannot be summarized in these Snippets. We suggest you borrow a copy of the De Rebus from one of your attorney friends and make a copy of this article.

CONGRATULATIONS - COMING OF AGE - LES REYNARD
During August this year Les Reynard (of our Eastern Cape Region) celebrated 21 years in sectional title management – starting off in 1984 as a “hobby”. He became managing agent and chairman of the complex he lived in.
He married his wife Heather in 1985 and the two of them have been working together ever since. Their business grew until he had to give up his employment to go into the business full time. He now manages 58 complexes with more on their way before the year-end.
Having decided to give back as much as he could to the industry that was supporting them, he joined the Sectional Title Association of Port Elizabeth and soon became a committee member. He has now served on this committee for 20 years and was also director of the local Institute of Realtors for 2 years with the portfolio of Finance and Sectional Title.
The Managing Agent’s conference, Les (and others) attended in Australia was his first holiday in 24 years! To him it was well worth the cost and he was surprised at how far ahead of us they are in this industry. He says it was like a glimpse into the future as far as this business is concerned here in South Africa.
Once again we would like to congratulate him with this achievement!
