Our trustees have issued a Warning Letter to our gardener, but refuse to give me a copy of that letter. I am an owner and have requested a copy in terms of PMR 27, sections (3), (4) and (5). They cite the reason that his personal details are in the letter, and such details are private. I feel that the BC is the Employer, and as I am a BC member, I am entitled to see all documentation in our employee’s file, including his employment contract and any Disciplinary matters, such as Warning Letters and Disciplinary hearings. The trustees also do not want to give me a copy of the Employment Contract. My question is “do the trustees have a right to withhold the Warning Letter and Employment Contract from me?”.
