VALUATION OF BUILDINGS
The following interesting response was received from one of our members:
“Re: SNIPPETS 1/2007 – VALUATION OF BUILDINGS
Reading between the lines of this section of your newsletter, in stating that the Trustees maybe held liable for under valued buildings, I forsee the distinct possibility that Bodies Corporate may be inclined to look to their Trustees Indemnity cover to compensate them as a result of their Trustees not ensuring buildings are correctly insured.
It must be clearly understood that the Trustees Indemnity cover is intended to provide indemnity for the Trustees in the event that they are negligent in their capacity as Trustee. It is also very important to note that discussion of the replacement value of the property forms an integral part of the AGM of all bodies corporate. As such all members are called on to jointly confirm and agree the insured value for the following period which in the view of the Insurer places the responsibility on all members (regardless of whether they attend the AGM or not) and not the Trustees.
So, in view of the above, unless the Trustees are clearly negligent in their duties, it is understood that all members of the Body Corporate must be held accountable and not the Trustees alone.”
OBJECTIONS TO THE CITY OF CAPE TOWN’S VALUATION OF SECTIONAL TITLE PROPERTIES ON THE 2006 GENERAL VALUATION ROLL
The City of Cape Town will implement individual billing of rates and services to owners of sectional title units on the basis of market value from 1 July 2007. From this date all sectional owners are to pay rates directly to the City (directly based on market valuations of their units) and service charges. Sectional title bodies’ corporate, which up to now only paid rates and service charges for the whole scheme, will only pay rates and service charges for any units registered in their names.

SCHOLARSHIP TO PREVIOUSLY DISADVANTAGED INDIVIDUALS
Most people are aware that the Estate Agency Affairs Board (EAAB), plans to introduce compulsory education for estate agents towards the middle of this year. This is a positive step towards professionalising an industry well known for its unprofessional conduct. According to the Estate Agency Affairs Act of 1976, those who manage sectional title property for a fee, are defined as estate agents and the EAAB has made provision for these managing agents in their new training program.
Paddocks and the University of Cape Town are offering five scholarships for previously disadvantaged individuals to attend the next six-month course, which begins on 4 June 2007.

MEMBERSHIP CERTIFICATES 2001/2008
The new membership certificates for the year ending 30 June 2008 will be issued during July 2007.
We will be issuing the bulk of the certificates via e-mail in a Pdf.format similar to that of 2007.
Please note that only members whose levies are paid up to date until 30 June 2007, will qualify for a new membership certificate.
Members who are in arrears for 4 months in respect of their membership fees, will automatically be removed from our distribution lists.
NATIONAL AGM 2007
As you know by now the Financial Year End for Nama is on 30 June 2007 and therefore our AGM will have
to be held before the end of October 2007.
Provisionally we are looking at 19 October 2007 for the AGM to be held in Durban. Final arrangements will be relayed to all our members in due course.
